Sobriety Testing
When you're pulled over for drunk driving in Massachusetts, the police will ask you to take a field sobriety test and possibly a breathalyzer test. Be polite to police officers but REFUSE the field sobriety test. This is your right and there is no penalty for refusing to take it.
Refusing to take the breathalyzer or chemical test, on the other hand, will result in the immediate suspension of your driver's license and under the new Massachusetts law, Melanie's Law, you will not be eligible for a temporary 15-day license. If you are under 21, you will face 3 years of license suspension.

Melanie's Law went into effect in October 2005. All of the consequences of that law are not yet know, but we do know that it significantly increases the penalties for repeat drunk driving offenders. With each additional offense, the penalties, fines, and jail time increase dramatically.
