Dividing Assets

Once the professional practice is valuated, the court will need to divide it along with the other assets. Just like in dividing business interests, as for all complex property division matters, the court will use the factors found in Massachusetts General Laws Ch. 208 §34 to determine how much of the asset each party will receive. For example, a spouse who was deeply involved with the other spouse in running the private practice for many years may in some instances receive a much higher percentage of the asset than the spouse who resisted or opposed the venture.
