Recent Changes to Alimony Law in Massachusetts • Attorney Andrew H. P. Norton
Effective March 1, 2012, Massachusetts is embracing an entirely new set of laws regulating alimony and spousal support. Previously, Massachusetts had very minimal regulations and almost no specific guidelines. Divorcing parties never knew what to expect or what criteria a given judge would use to determine alimony.
The new changes revamp this legal scheme completely. Some of the most important changes include:
• Time limits on alimony: Massachusetts never had a time limit on alimony in the past, but now, most alimony orders have an end date that is determined based on the length of the marriage and other factors. Time limits may also be based on the type of alimony being paid.
• Distinguishing different type of alimony: Whereas previously there was only one kind of alimony, now the law distinguishes between general alimony, rehabilitative alimony, reimbursement alimony and transitional alimony.
• Alimony formula: With the new law, Massachusetts Family Court Judges now will use a formula for determining the amount of alimony to be paid. For the time, Massachusetts has a formula with specific elements for determining the amount of alimony to be paid in each case.
